Cosby team triumphant, but sex crime retrial, lawsuits loom

A United States judge declared a mistrial Saturday in Bill Cosby's sexual assault case with the jury deadlocked on whether the disgraced star drugged and molested a woman in 2004, as prosecutors vowed to seek a retrial.

District Attorney Kevin Steele said Friday he would push for a retrial as soon as possible, reassess the case and possibly make some "tweaks". Later in the day, the jury reviewed Cosby's six-hour 2005 police interview in which he acknowledged giving Constand anti-allergy pills but characterized the encounter as consensual "petting".

A judge has declared a mistrial in Bill Cosby's sexual assault case in Pennsylvania, but the comedian's civil lawyers are still fighting lawsuits against him by 10 women around the country.

In an exclusive interview with CNN's Jean Casarez, attorney Brian McMonagle said the jury's inability to reach a verdict made it clear the trial should end.

The entertainer, who had an endearing reputation as "America's Dad" from his years as the lovable Cliff Huxtable on "The Cosby Show", faces up to ten years in prison on each of the three counts.

He added that jurors should be proud of how they handled the case even though they could not reach a unanimous verdict. But what I will say is that I applaud this prosecutor, this judge, this young woman who came forward for at least attempting to uphold what we believe was the rule of law - that equal protection applies to Mr. Cosby just as it does to the victim in this case.

She said the incident left her "humiliated" by someone she had thought of as a friend and mentor. The defense had hoped, if it did, to introduce evidence she had previously dated a man.

"He assisted me over to the couch and just said, 'Relax, just lay down here, you need to relax, '" she testified. Cosby has denied any wrongdoing. Judge Steven O'Neill instructed them to keep working toward a unanimous decision.

The jury was comprised of seven men and five women.

Several of the women have continuing cases in which they have sued Cosby for slander after his representatives suggested that their accounts were fabrications. He was kind enough to join us from Philadelphia.

Still, legal experts say, it won't be impossible to find 12 people to sit in judgment of Cosby, who turns 80 next month. However, it looks as if those deciding Cosby's fate are hopelessly deadlocked. Other jurors were harder to read.

The case involving Constand followed a long path to prosecution.

She once served on a jury where the foreperson was the lone holdout for an acquittal.

Cosby, on the contrary, said Constand never stopped him when he made his moves.
